I sold my car used from someone and not happy with him and has now led me to small claims court. He had a contract, the school was for the state. All private sales are "as is" unless there is a written guarantee given by the seller. You have nothing to prove, he must demonstrate that it has given a guarantee. Good luck.

You can have your time and theirs. He bought a used car from a private party. Provided that they deliberately hide the problems, such as filling in a block of cracks with putty, or whatever, then no action against him.
